When should I file a worker’s compensation claim?

On Behalf of | Aug 13, 2018 | Workers' Compensation |

Workers who are injured on the job deserve to receive compensation for their medical bills and lost wages. For a claim to have a higher chance of success, injured workers should file as soon as possible.

According to Ohio law, injured workers have within one year of the date of the injury to file a claim. That may seem like a long time, but workers’ compensation claims can take a long time to be approved and pay out.

Some of the benefits workers are eligible for include:

  • Medical care
  • Temporary total disability
  • Permanent partial disability
  • Permanent total disability
  • Wage loss
  • Death benefits

The Bureau of Workers’ Compensation has 28 days to approve or deny a claim, and injured workers have 14 days to appeal the decision. The bureau requires several pieces of information, and a claim is more likely to be successful if there is as much detail as possible. Collecting those necessary details takes time, so starting the filing process right away will give workers the time they need to provide the necessary information for a claim to be approved.

In many cases, workers’ compensation claims are more complex than an injury for which workers file a claim. A workplace injury can also be the result of negligence by a third party or due to the employer’s violation of safety requirements. A personal injury attorney can help sort through all the filing paperwork and determine if there are further damages available. Their knowledge can save workers time and get a claim processed more quickly.
